Legislation

Article 19 of The Education (Northern Ireland) Order 1996 states that a pupil’s Statement of Special Educational Needs must be reviewed each year.

The Order also made provision for Statutory Regulations that would detail the manner in which the Annual Review of a Statement should be conducted and who should participate in such a review.
These arrangements are to be found in The Education (Special Educational Needs) Regulations (Northern Ireland) 2005. Part IV paragraphs 6.4 – 6.16 are particularly relevant to the  14+ Annual Review.

When planning for and carrying out such a review Education and Library Boards must also have regard to The Code of Practice on the Identification of Special Educational Needs. In addition, in September 2005, the Department of Education published a Supplement to the Code of Practice to have regard to the Special Educational Needs and Disability Order 2005.

The following legislation applies to the Education Transitions Service.
